Former Royal Marine sues MoD for £200,000 over claims military service left him deaf
Richard King, 58, accuses forces of breach of duty as he suffers from ‘noise-induced’ injuries
A former Royal Marine captain who served in some of the deadliest trouble spots around the world is suing the Ministry of Defence over claims his military service left him deaf.
Richard King spent 36 years with the Royal Marines , undertaking several tours of duty in Northern Ireland and being deployed to Afghanistan.
The 58-year-old, who rose to the rank of Captain, suffers from high-frequency sensorineural hearing loss, as well as tinnitus, and claims his injuries have left him permanently disadvantaged in the open labour market.
He is now seeking damages of more than £200,000, accusing the Ministry of Defence (MoD) of negligence and breach of duty.
The MoD has admitted breach of duty but requires him to prove that he has suffered a noise-induced injury, and says his claim should be delayed until test cases for noise-induced injury are decided in October 2025.
He is one of hundreds of servicemen and women who are claiming similar compensation from the MoD for deafness they blame on their time in the forces.
They had hoped to come together in group litigation, but this was refused last October. Their claims are now going ahead through test cases to decide a number of legal issues.
According to documents lodged with the High Court, Mr King, who joined the Marines in October 1981, spent most of his career training units with the Royal Marine Commandos Unit.
He was required to take part in blank firing exercises and claims that he carried out these duties both with and without adequate ear defences, saying that if he had worn them throughout, he would not have been able to hear what those around him were saying.
As part of his duties, Mr King, who is from Newton Abbot in Devon, used to shoot his weapon in the enclosed space of “pipe ranges”.
Surriya Akhtar, Mr King’s lawyer, stated: “He recalls his ears would be ringing after such exercises. During some of those exercises, it was not possible to hear what anyone was saying or shouting to each other.”
Mr King claims that the ear defenders he wore did not fit properly when he was wearing his helmet. He also says that during active engagement in Belfast, when rubber bullets were fired, he did not wear any ear defence to keep his situational awareness.
Mr King’s legal team argue that when he was deployed to Afghanistan, he was exposed to different types of weapons, including explosive devices, hand grenades and heavy machine gun fire.
Ms Akhtar says: “Ear protection was supplied but it was to be worn “half off” his ear so that he could hear voice or deliver voice himself.”
Inadequate ear defences
Mr King went on a jungle warfare course in Brunei in 1996. This involved live training attacks while crawling through undergrowth.
He says there was no ear defence because it was a live environment, and soldiers used plastic explosives to blow up trees and clear areas as Wessex and Sea King helicopters clattered overhead.
Mr King says while travelling in Hercules helicopters before a parachute jump, he was usually given yellow foam ear defenders, but these did not allow situational awareness and that even when they were worn, they did not reduce the noise of the engine.
The MoD wants his claim to be stayed until the test cases are heard, or scheduled to be heard after the test cases.
It says that although it admits breach of duty, Mr King is required to prove that this caused him injury.
The MoD also disputes he is disadvantaged in the open labour market and wants a report from its own medical expert.
Since leaving the Royal Marines, Mr King has worked as a financial advisor, particularly to former service personnel and their families.
