Dubai Public Prosecution online service to help lift travel bans

The system allows defendants to pay court fines and is in line with efforts to streamline legal services for the public.

A new online service launched by Dubai Public Prosecution will allow defendants to pay court fines and automatically lift travel bans.

The Smart Payment of Fines service falls under a policy adopted in the emirate to reduce visits to service centres, which promises to save more than 300,000 working hours annually in government departments.

Shamsa Al Marri, director of strategy and institutional excellence at Dubai Public Prosecution, said the new digital approach facilitates fine payments related to criminal judgments through online channels.

“It covers a broad spectrum, from judgments passed in person or in absentia across all stages of legal proceedings,” she said.

She said arrest warrants will be immediately revoked, because the service is connected to Dubai Police.

“This innovative move will enhance customer satisfaction, significantly reduce in-person visits to the prosecutors and streamline the overall payment protocol,” Ms Al Marri said.

How it works

When a verdict is issued by a Dubai court, offenders will receive an SMS from the prosecutors with details of the verdict, the fine issued and a payment link.

They click on the payment link which redirects them to a login page. After authenticating with a digital ID, they can complete the payment.

Alternatively, fines can be paid at one of the kiosks mentioned in the SMS or through the prosecutors's official website.

After payment, prosecutors will confirm the cancellation of any arrest warrants and lifting of the travel ban in a text message.

The text message will also include a link that directs users to a portal where they can download a copy of the cancellation notice.

What is a travel ban?

A travel ban under UAE law is an official order that either restricts an individual from entering or re-entering the country or bars them from departing until certain conditions are fulfilled.

The ban remains in place until the underlying reasons for its imposition are resolved.

“It's enforced by authorities across all points of entry and exit to ensure the individual in question cannot enter or leave the UAE,” legal consultant Hassan Elhais of Al Rowaad Advocates in Dubai said.

Travel bans can be imposed for a variety of reasons.

“While there is no specific law that comprehensively deals with all types of travel bans and the procedures for executing them, UAE courts enforce bans on several grounds,” said Mr Elhais.

“These grounds include violating immigration laws, debt or under personal status law matters. One of the most common reasons for a travel ban being issued is because of debts.”

He said before the new system, offenders had to first pay their fines and then use the payment receipts to request the removal of arrest and travel bans.

“This required the convicted person or their legal representative to liaise with both the prosecution and the police to cancel any travel bans, arrest orders or searches against them.

“Now with the smart fine payment service, paying fines electronically through the prosecution system will automatically revoke related arrest and travel bans,” Mr Elhais said.

A travel ban prohibits an individual from entering, re-entering or leaving the country until the grounds for issuing the travel ban have been dismissed. Although the UAE does not have an entire legislative framework governing the travel ban system, Article 94 of Federal Law No. 6 of 1973 concerning immigration and residence, and its executive regulations (as amended by the Ministerial Decree No. 83 of 2002) aims to provide some clarity on the grounds for the imposition and enforcement of travel bans. Pursuant to Article 94, a travel ban may be imposed for several reasons including breach of immigration laws, unpaid debts, criminal offences and personal affairs. This article aims to provide an in-depth understanding of travel bans issued as a result of a criminal offence.   

A travel ban is not to be confused with an arrest warrant. The aim of an arrest warrant is to detain an individual accused of committing a crime for the purpose of conducting a criminal investigation or execution of a court judgment, whereas the aim of a travel ban is to prohibit such an individual from entering or leaving the country for the purpose of protecting public or private interests. Imposing a travel ban does not necessitate an automatic arrest and detention. If the ban has not been granted on the grounds of committing a crime, the accused individual will only be prohibited from either entering or exiting the country. Alternatively, if an arrest warrant has been issued, a travel ban is automatically issued until the investigation has come to an end or the court has made a judgment. 

Furthermore, if an individual in the UAE is under investigation for committing a criminal offense, including but not limited to theft, fraud, possession of illegal drugs, homicide or rape, an automatic travel ban is issued by virtue of Article 94 of the executive regulations of the Federal Law No. 6 of 1973 concerning immigration and residence. A travel ban may also be issued as a result of commercial or civil transactions that necessitate a criminal penalty, such as cases involving bounced cheques, however, a police complaint must be filed by the beneficiary of the bounced cheque in order to start the investigation and issue a travel ban on the accused individual. 

Travel bans based on a criminal offence are imposed by the police, the public prosecution or the court and shall remain enforceable until such time that the investigation is complete, a judgment of the case has been issued, or the sentence granted to the individual for the crime has expired. In limited situations, if the criminal case is ongoing, the accused may request the court to grant bail, however, it should be noted that the bail only pertains to being released from police custody, the accused will not be allowed to travel until such time that the final judgment has been issued. 

In certain circumstances, an enforced travel ban may contradict a deportation order issued by the relevant authorities when an expat is considered a threat to the public health or public order of the country. If such a situation arises, Article 329 of the Civil Procedures Code provides that a special committee headed by a competent judge must be formed to settle the matter. 

Although there are no official UAE government portals that provide a service relating to checking whether a travel ban has been imposed, the Dubai Police has recently launched a free online service enabling individuals to check their travel ban status if the travel ban has been issued on grounds of bounced cheques and other financial matters. If there is uncertainty on whether the grounds for the enforcement of the travel ban are limited to bounced cheque cases, the status of the travel ban will have to be checked personally at the Dubai Police Department. Alternatively, the status of the travel ban may be checked by an attorney of the individual provided that the attorney has the individual’s passport copy and an effective power of attorney.

Dubai: Dubai Police have urged residents to check their “criminal status in financial crimes” as well as travel bans through Dubai Police app or via the Smart Police Stations.

In video message tweeted on Friday, Dubai Police took residents through the steps on how to inquire about  “criminal status in financial crimes” and travel bans.

“Be on the safe side, check your criminal status,” it said.

All one has to do is to log into the Dubai Police app, go the "criminal services" section, choose the "criminal status in financial crimes” option, enter the Emirates ID number and verify via SMS.

In case of travel ban, the person will be directed to the concerned department if there is a ban.

Since the Dubai Police set up a smart service that allowed the public to check if a debt-related travel ban has been issued against them, more than 75,000 residents of 150 nationalities have benefitted from it, authorities have revealed. Over a half a million inquiries have also been processed, leading to the recovery of Dh2.6 billion and savings of over Dh18 million, the Dubai Police said at a meeting of the Strategic Affairs Council of The Executive Council of Dubai on Tuesday. The platform, which was introduced in 2018, can be accessed through the Dubai Police website. Users will be able to inquire about their 'criminal status' in financial cases and verify if police or judicial entities have issued a travel ban against them. Besides the Web-based service, the police also sends an SMS to individuals charged in financial disputes involving small amounts of money. The SMS notifies residents about any travel ban and gives them the opportunity to settle their cases. More than 21,000 individuals of 137 nationalities have availed of the SMS service, helping the Dubai Police recover Dh2.1 billion and facilitate savings of Dh38 million. Strategic affairs meeting At the Strategic Affairs Council meeting chaired by Sheikh Maktoum bin Mohammed bin Rashid Al Maktoum, Deputy Ruler and First Deputy Chairman of The Executive Council of Dubai, other government entities also discussed the success of their innovative projects. Smart Dubai reported that its Dubai Paperless Strategy has so far enabled 33 government entities to cut paper consumption by 67 per cent, saving 195.4 million sheets of paper from a total of 293.2 million consumed annually. It also allowed entities to save Dh831 million; 8.8 million hours of work; and 23,448 trees. Smart Dubai is working to transfer 100 per cent of the Dubai Government's internal transactions and public services to digital platforms before the end of 2021. The Knowledge and Human Development Authority (KHDA), on the other hand, presented a report about private education and its role in enhancing Dubai's position as an international knowledge economy hub. It found that the private education sector, which serves 300,000 school students and 50,000 higher education students, contributes Dh18 billion to the Dubai economy. [email protected]

• Go to the documents section and click on the file link to download the PDF for printing.

Step 1: Submit a Case Request

Follow these steps to submit your case request for the cancellation of your travel ban:

• Visit the official website of the Ministry of Justice and go to the service request ‘ Cancellation Request of Travel Ban Order ’. 
• Click on ‘Start Service’.
• Sign in to your account using your UAE Pass account and you will be directed to your personal dashboard. 
• Click on ‘My Cases’ under ‘Case Management’. This page will give you the complete list of the cases that are related to you. 
• Click on the eye icon beside it to view the details of the case. 
• You can see several options available like ‘add lawyer’, ‘remove lawyer’, and ‘request’. Click on the ‘request’ button. 
• Fill in the form by providing the details of your request and your case. According to the Ministry of Justice, the options you see under ‘request’ will vary depending on the case. Some cases may be subject to paying a specific amount. The request will only be routed for approval once it is submitted and paid for. Some may even require the approval of the court judge.
• Upload necessary documents.
• Click on ‘Submit’. 

Step 2: Pay for Your Request

Once your request is submitted, you are required to make payments if asked to do so, depending on your case. If you want to check the amount that you need to pay, follow the steps given below:

• Enter your application’s reference number 
• After you click on a box in the right-hand corner of your screen, you will be directed to another page
• This page will have the details regarding the amount that you need to pay. 
• Click on ‘Continue’ to make the payment

Step 3: View or Print the Request

If you would like to view or print your request, then follow the steps given below:

• On your personal dashboard, you can find an option ‘Case Management’ 
• After clicking on ‘Case Management’, go to ‘Cases’
• Click on the eye icon to view your case files
• Then you can go to the documents section and click on the file link to save the copy and print it out. 

As per the Ministry of Justice’s website, your application will be processed within five working days. If your request gets approved, your travel ban will be canceled. The website also allows you to track the progress of your request through your personal dashboard.

Pope will travel to Indonesia, Papua New Guinea, East Timor and Singapore in longest trip of papacy

Pope Francis will visit Indonesia, East Timor, Papua New Guinea and Singapore in September, the Vatican announced Friday, confirming the longest trip of Francis’ papacy that is sure to test his health, stamina and mobility.

The Vatican confirmed the Sept. 2-13 visit, saying the 87-year-old pope would visit Jakarta, Indonesia; Port Moresby and Vanimo, Papua New Guinea; Dili, East Timor; and Singapore. Further details will be announced later.

Francis’ health has become a source of increasing concern and speculation, even though the pontiff is able to carry on with a rigorous schedule of meetings at the Vatican and even excursions to local parishes.

Francis, who had part of one lung removed as a young man, had to cancel a planned visit to Dubai late last year after he came down with a bad case of bronchitis. He suffered from respiratory problems all winter and had to curtail his participation in Holy Week events to save his energy for Easter.

Francis has also been using a wheelchair for nearly two years because of bad knee ligaments, and has said that traveling has become increasingly more difficult.

And yet at 11 days, the trip would be the longest of Francis’ papacy, outpacing by a few days some of his long trips to the Americas early on in his 11-year papacy. It will bring the Argentine Jesuit to the world’s most populous Muslim nation, Indonesia, as well as the former Portuguese colony of East Timor, where the Catholic Church wields enormous influence.

There is also a chance of another leg to the trip being added later: This week, the Vatican foreign minister, Archbishop Paul Gallagher, was in Vietnam and discussed a papal visit, Vatican News reported, without providing details.

In a statement announcing the visit, the Indonesian foreign ministry welcomed the visit and recalled that it had originally been scheduled for 2020 but was postponed because of the COVID-19 pandemic.

“The visit of Pope Francis to Indonesia holds significant importance to the Indonesian people, not only for Catholics but also for all religious communities. The visit is also expected to strengthen the message of tolerance, unity and world peace,” the statement said.

Indonesia is home to roughly 242 million Muslims and 29 million Christians — 8.5 million of whom are Catholics — according to a 2022 report by the Religious Affairs Ministry.

East Timor, which today has a population of about 1.2 million people, is Southeast Asia’s only predominantly Christian nation with the exception of the Philippines. According to the 2015 census, 97.6% of East Timor’s population is Catholic.

The visit to East Timor will likely reignite attention over a clergy sex abuse scandal involving its revered independence hero and Nobel Peace Prize winner. The Vatican confirmed in 2022 that it had sanctioned Bishop Carlos Ximenes Belo following allegations that he sexually abused boys there during the 1990s. Belo is believed to now be living in Portugal.

Francis will be the first pope to visit Papua New Guinea since St. John Paul II went there in 1984. The country, in a strategically important part of the South Pacific, has struggled with tribal violence and civil unrest.

John Paul also visited Singapore, in 1986. The country today is home to 395,000 Catholics and Francis in 2022 made its archbishop Singapore’s first cardinal.

In a statement welcoming the visit, Cardinal William Goh, said it “will bring renewed fervor to all Catholics in Singapore, uniting them in faith and mission, especially in these most challenging of times.”

The Vatican has planned only one other papal trip this year — to Belgium to celebrate the anniversary of the country’s Catholic university. Francis has also said he wants to return to his native Argentina , but no plans or dates have been announced.
